Full Time Membership Terms & Conditions
The Licensor is the owner of Premises at 2 Epsom Road, Zetland, NSW 2017 (hereinafter called “the Premises”).
The Premises comprises a number of desk stations, offices and communal facilities.
The Licensor has agreed to grant to the Licensee a licence to occupy a desk within the Premises and to share with other Licensees the use and benefit of the communal facilities on the terms and conditions hereinafter appearing.
NOW THIS AGREEMENT WITNESSES AS FOLLOWS:
The Licensor licenses the Licensee to the use and occupation of an office or desk station(s) subject to the following conditions.
Date of Commencement
This Licence shall commence on the date of this Agreement.
Term of Licence
The Licence is for a term of one month and thereafter from month to month.
Rent
On the signing of this agreement, the Licensee shall pay the agreed sum.
and thereafter from month to month in advance
Deposit
On the termination of this Licence, the deposit shall be refunded to the Licensee subject to any deduction arising from the cost of remedying any breach or default by the Licensee of the terms and conditions of this Licence.
Notice of Termination of Licence
Either the Licensor or Licensee may terminate this Licence at any time by one month’s notice in writing to the other PROVIDED THAT in the event of breach of any condition of this Licence by the Licensee, the Licensor may terminate the Licence on 7 days notice to the Licensee.
Ownership of Desk, Chair, Shelving, Under Desk Filing Cabinet, Cabling
Throughout the Licence, the ownership of the desk, chair, shelving, under desk filing cabinet and cabling remains with the Licensor and the Licensee shall not remove, replace, modify or alter any of these items without the consent of the Licensor which consent may be given or withheld in the absolute discretion of the Licensor.
Use of Communal Facilities
The Licensee shall in conjunction with other Licensees have the shared use of the following communal facilities:
Meeting room
Kitchen
WC x 4
Lounge
Podcast Studio
Telephone booth x 2
Photography Studio
In relation to the meeting room, podcast studio and photography studio the use and occupation by a Licensee is subject to reservation by means of entering on a calendar system provided by the Licensor with fees payable by the licensee. The mutual respect of the Licensee to other Licensees in the use of the communal facilities is essential to the orderly conduct of the Licensees occupying the Premises.
Printer/Scanner/Copier/Internet Access
The Licensor has provided a printer/scanner/copier as well as internet access for the reasonable business use by Licensees and shall maintain it in working order and condition and supplied with standard paper. In the event of interruption, failure or breakdown to any of these services, the Licensor will use his best endeavours to reinstate the service but shall not be responsible for any reasonable delay in either the replacement or restoration of any of these services. The use of the printer is free for the first 100 pages per month. After which each sheet of A4 is charged at 10c/sheet and each sheet of A3 at 20c/sheet.
Payment of Electricity
The Licensor shall meet and pay all tax invoices for electricity to the Premises.
Indemnity in Favour of Licensor
The Licensee shall indemnify and keep indemnified the Licensor from and against all claims, actions and demands howsoever arising from the Licensee’s occupation and use of the desk station(s) or offices and the shared use of the communal facilities with other Licensees.
Workers Compensation and Other Insurances
The Licensee shall be responsible for the taking out of any insurances in the nature of Workers Compensation and Equipment Insurances.
24 Hour Access to the Premises
The Licensee shall have 24 hour access to the Premises. In enjoying such access, the Licensee must ensure the securing of the Premises upon leaving the Premises in situations where the Licensee is the only person present on the Premises.
Mutual Benefit
The Licensee acknowledges that in occupying part of the Premises, it will act in a manner to respect the rights of other Licensees who shall be occupying other parts of the Premises under the same terms and conditions as this Licence including sharing communal facilities with the other Licensees.
Securing of Licensee’s Property
It is the responsibility of the Licensee at all times to keep safe and secure all of the Licensee’s plant and equipment and other material which the Licensee may bring onto the Premises at any time. In particular, the Licensee acknowledges that the Licensor has no responsibility to the Licensee for the securing and keeping safe of the Licensee’s property.
Club Membership Terms & Conditions
THIS LICENCE AGREEMENT
BETWEEN: You the Licensee, and
MICHAEL BRADFIELD PTY LTD (t/a The Roller) [ABN 91 099 758 246] of 2 Epsom Road, Zetland, NSW 2017 (hereinafter called “the Licensor”) of the One Part AND
……………………………………………………………………………………………………………………………………………
(hereinafter called “the Licensee”) of the Other Part.
BACKGROUND
